  1. Company Summary

  2. Definitions
    1. Bidder – A person who submits bids for the purchase of a Vehicle
    2. Buyer – The bidder who submitted the highest bid at the end of an Auction, subject to the Reserve being met
    3. Seller – A person who has submitted a Vehicle listing for sale on the Platform by auction.
    4. Buyer’s Premium – A fee paid by the Buyer when an auction ends with them as the highest bidder.
    5. User – Anyone who registers for an account with the Platform.
    6. Platform – www.dreamgarage.auction
    7. Auction – A Vehicle listed for sale on the Platform, including those listed as "Coming Soon"
    8. Reserve – A minimum sale price stipulated by the Seller
    9. Vehicle – A lot listed for Auction on the Platform
    10. Listing – A Vehicle listed for Auction on the Platform

  3. User Undertaking
    1. Dream Garage Auctions provides a platform solely for Buyers to bid on and sellers to list Vehicles for sale. We do not own any Vehicle listed for sale nor are we in any way a Vehicle broker or act as agent of the seller.
    2. Users agree they are entirely responsible for any costs incurred through the use of this Platform.
    3. Users agree to not use the Platform for any unlawful act including but not limited to fraud, distribution of malware, phishing or money laundering.
    4. Responsibility for settling funds for the transaction lies entirely with the Buyer and the Seller.
    5. Users agree not to attempt to circumvent any authentication mechanism of the Platform.
    6. Users agree not to disclose any credentials they possess for the Platform to a third party under any circumstances.
    7. Users agree not to attempt to buy or sell any Vehicle on the platform while an Auction is live and accepting bids, or listed as "Coming Soon"
  4. Seller Terms
    1. The Seller must provide ID in the form of a passport or driving licence, as well as the V5C belonging to Vehicle before we will accept the listing.
    2. The Seller must provide details of any outstanding finance on the Vehicle
    3. Once a Listing is live, the Seller commits to the Vehicle being exclusively listed with the Platform and may not use another means of sale unless the Auction fails to produce a winning bid in excess of the Reserve.
    4. The Seller is entirely responsible for the accuracy of the listing including but not limited to condition, ownership history, service history and defects.
    5. The Seller must be the legal owner of the Vehicle, free to legally sell the Vehicle on the Platform and be able to transfer ownership to the Buyer.
    6. The Seller may also list a “Buy Now" price, if a Buyer triggers a sale via “Buy Now", the Seller agrees to sell the Vehicle to the Buyer at this price, regardless of what bids have already been placed.
    7. The Company will not disclose the details of a given Bidder, with the exception of that of the Buyer in order to complete the sale.
    8. The Seller may not facilitate a direct sale of the Vehicle under any circumstances while the Auction is live and accepting bids. Doing so will incur a penalty of 5% of the Reserve amount to the Seller (minimum £500).
    9. If an Auction fails to meet the Reserve, the Seller may not subsequently sell the Vehicle to a User who has either place a bid at any point during the Auction, or who has viewed the Vehicle when the Company put them in contact with the Seller.
  5. Bidder Terms
    1. All fees are paid using our payment provider Stripe, card details and related information are submitted directly to Stripe.
    2. Bidders are required to pay £0.30 Sterling prior to making their first bid, as a one time payment for that User, to validate their authenticity. The amount of £0.30 is the minimum amount our payments provider allows.
    3. The Buyer will be charged a fee of 5% of the final selling price of the Vehicle. The card used to make the verification payment in 6.2 will be automatically charged at the completion of the Auction to which they are the highest bidder and the Reserve has been met.
    4. No card details are stored by the Company, Stripe stores an encrypted, tokenised form of the card to allow this automatic charging.
    5. By submitting payment details, Users agree to abide by the terms of service set out by Stripe.
    6. Should Stripe be unable to charge the fee, the Buyer has two working days to make the payment by alternative means. Failure to do so will result in the next highest bidder being declared the Auction winner.
  6. Cancellation
    1. Users have the right to close their accounts on the Platform at any time by contacting the Company informing them of their wish, with the exception of if they are participating in a live Auction. If the Seller withdraws during a live Auction the Seller is liable to pay the Company a penalty charge of 5% of the Reserve value (minimum £500).
  7. Sales outside Dream Garage Auctions
    1. Sellers and Buyers shall not engage in any activity designed to complete or facilitate a transaction for the sale or purchase of any Vehicle outside of the Platform, while an Auction exists. If any sale of any Vehicle is concluded outside of the Platform in any event both the Seller and Buyer will each be obliged to pay the Company a penalty charge of 5% of the Reserve value (minimum £500).
    2. Should an outside sale occur of a Vehicle that has been listed on the Platform but completed without selling, should this be conducted with a Buyer who had contact of any form with the Company with regards to the Vehicle then this transaction is considered a Buy Now transaction and the Buyers Premium will be due against the last agreed Reserve.
  8. Availability
    1. While the Company makes every effort to minimise any downtime of the Platform, no guarantee or warranty is provided in the event the Platform is offline for any duration of time.
  9. Disputes
    1. The Company is in no way liable for any dispute between the Buyer and the Seller, any such matter must be resolved between the Buyer and the Seller directly.
    2. The Company reserves the right to remove a live Auction, regardless of any bids that have taken place for any reason.
  10. Intellectual Property
    1. The Platform and all intellectual property rights are owned by the Company. Intellectual property rights means rights such as: copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We and our licensors reserve all of our and their rights in any intellectual property in connection with these Terms. This means, for example, that we and they remain owners of them and free to use them as we and they see fit.
    2. Users agree that nothing grants you any legal rights in the Platform other than as necessary to enable you to access the Platform. You agree not to adjust to try to circumvent or delete any notices contained on the Platform (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Platform.
    3. When any content uploaded or posted to the Platform, the Users grants a royalty-free, perpetual, worldwide, transferable licence to use, reproduce, modify, distribute and display such content in connection with the service provided by the Platform as well as for other media and marketing purposes. The User must be the owner of any such content that they upload.
  11. Age Restrictions
    1. All users must be atleast 18 years of age at time of registration.
  12. Limited Liability
    1. Except for any legal responsibility that cannot be excluded in law, the Company is not legally responsible for any losses incurred, directly or indirectly, including but not limited to loss of profit, data, opportunity, reputation, contract or production.
    2. The Company is in no way liable should the Buyer or the Seller fail to fulfil their obligations of a sale contract following a completed Auction.
  13. Jurisdiction
    1. This Agreement shall be governed by the laws in force in England and Wales. The offer and acceptance of this contract is deemed to have occurred in England.
